On the 15th of June 2017 in Szeged, Hungary, Ahmed H. had his second instance trial, after being sentenced to 10 years of prison on the 30th of November 2016 for committing an "act of terrorism". A bíró az ügy újraértékelését kérte az elsőfokú bíróságtól, Ahmed H.'s trial, act two - 2nd instance court decides Ahmed H.s terrorism charges need to be re-consider due to "lack of reasoning and interpretation" Two days ago, on the 15th of June 2017 in Szeged, Hungary, Ahmed H. had his second instance trial, after being sentenced to 10 years of prison on the 30th of November 2016 for committing an "act of terrorism". The prosecution, obviously, emphasized that the first instance hearings followed European law guidelines. They demanded a higher sentence for Ahmed H., close to 17,5 years. The new lawyer, P. Bárándy - former minister of justice of the socialist-liberal coalition - seemed well prepared and questioned many contradictory interpretations of the first instance judgment. The defense argued that the verdict is faulty, using "special" words to create a "certain" atmosphere, containing non-relevant information (for example Ahmed H's religious affiliations) and that "there are about 200 technical errors". The evidence, according to the defense, was used selectively to support the argument of Ahmed H. being a terrorist. The judge decided to refer the case back to the first instance court, claiming that although the evidences were properly established, there was a lack of reasoning and interpretation. The judge also suggested, that the first instance court needs to set up if Ahmed H's acts (especially the alleged stone throwing) were a "deliberate attempt of forcing the state" or an act of "despair" or "anger" in order to determine if the terrorism accusation is correct. A couple of days ago, Orbán responded to the criticism of the EU parliament regarding the trial of Ahmed H., saying that "the obvious lies of Ahmed H." are more important to Brussels than the security of Hungarians, since they ignore the "fact" that "Ahmed H. had seven passports and he convinced other migrants to break through the border." In the end it is necessary to doubt in the first instance court-decision and support the efforts of Ahmed H's defense. But should we rest our hopes in the Hungarian legal system and believe in their independence? Didn't the whole Röszke trials expose the Hungarian legal system as the willing servant of the government's ambitions? We think that the "new" first instance trial will be as much dependent on the political atmosphere as the previous ones. In the end it is not a question of "law" and "objective reasoning" but rather a political struggle. We believe in a world of equality, dignity and freedom for all. We will keep on fighting until Ahmed H. is free and we will not fall for the attempts of creating a fiction of legality. P.S. Az ügyészség hangsúlyozta, hogy az elsőfokú bíróság az eljárás során mindvégig követte az EU-s iránymutatásokat és továbbra is súlyosabb, 17,5 évhez közeli börtönbüntetés kiszabása mellett érvelt. Ahmed H. új ügyévdje, Bárándy Péter, egykori MSZP-SZDSZ igazságügyi minister felkészültnek tűnt és beszédében az elsőfokú ítélet több ellentmondásos érvét megkérdőjelezte. Az ügyvéd kritizálta az elsőfokú ítélet retorikáját, különösen azokat a “hangulatfestő” kifejezéseket, és irreleváns információkat melyek Ahmed H. vallási hovatartozását hangsúlyozzák, továbbá közölte a birósággal hogy az itéleben kb. 200 tehnikai hibát talált. A védelem szerint az elsőfokú biróság a bizonyitékokat szelektiven értékelte, olyan érveléseket támogatva melyek szerint a terorizmus vádja indokolt. A másodfokú biróság az ügy újratárgyalását rendelte el, kijelentve hogy habár a bizonyitékok helyesen kerültek bemutatásra, az itélet értelmezésben és érvelésben hiányos. A biró javaslatára az elsőfokú biróságnak kell majd újra határozatot hoznia arról hogy a terrorcselekmény vádja megalapozott-e, illetve hogy Ahmed H. cselekedetei (különösen az állitólagos kődobálás) „egy állami szerv intézkedésre való kényszeritésének szándékos kisérlete” volt-e vagy a „kétségbeesés” cselekedete. Orbán Viktor válaszolt az EU parlament kritikájára, mely Ahmed H. tárgyalására vonatkozott, ebben az állt hogy "Ahmed H. egyértelmű hazugságai” többet jelentenek Bruxellesnek mint Magyarország biztonsága, mivel mellőzik a "tényt” hogy "Ahmed H.-nál hét útlevelet találtak és hogy ő vette rá a többi migránst hogy áttörjenek a határon.” Az elsőfokú biróság igazságszolgáltatásában szükségszerűen kételkedni kell, és támogatni mindazon törekvéseket melyek segitik Ahmed H. védelmét. Vajon hogyan bizhatnánk a magyar jogrendszerben és annak függetlenségében? A Röszkei perek bemutatták a MAGYAR jogrendszer mivoltát, hogy miképpen szolgálja a kormány beteges törekvéseit. Úgy gondoljuk hogy az „új” elsőfokú tárgyalás csakúgy mint az előző tárgyalások, a politikai légkörtől nagymértékben függő lesz. Végül is, itt nem „törvényről” vagy „tárgyilagos értelmezésről” van szó, hanem politikai küzdelemről. Hiszünk egy olyan világban melyben az egyenlőség, méltóság és szabadság mindenki számára létező. Küzdeni fogunk Ahmed H. szabadságáért és nem esünk a törvényesség fikciójának csapdájába. P.S. Ahmed H.-t, tíz másik emberrel együtt (az úgynevezett „Röszkei 11-et”) véletlenszerűen választotta ki és tartóztatta le a rendőrség. Míg a többi tíz elítélt már letöltötte 1-3 évig terjedő börtönbüntetését, Ahmed H. 2015 óta börtönben van tudatosan elszigetelve, senki sem kapott engedélyt a látogatásra. A bíróság a rendőri tanúvallomások és a „bizonyítékok” rendkívül elfogult felhasználásával Ahmed H.-nak a tüntetés állítólagos „vezetőjeként” ítélt tíz év börtönbüntetést. A röszkei koncepciós pereket az Európai Parlament 2017 májusában megszavazott határozata is elítélte. A Fidesz válaszában kijelentette, hogy Ahmed H. támogatásával az Európai Parlament terrorizmust támogatja. Más ismert nemzetközi szervezetek is élesen bírálták a bírósági ítéletet. Mindemellett a tárgyalások anyagát kezelő Szituációs Nyelviskola Kft. egyik alkalmazottja ellen nemrég eljárás indult az egyik vádlott vallomásának meghamisítása miatt. A bírósági eljárás és a rendkívül magas börtönbüntetés annak a rasszista politikának az elemei, melyben a migránsok és menekültek lehetséges veszélyforrásként bármikor az állam és az igazságszolgáltatás célpontjába kerülhetnek. A per tökéletes példája annak az egyre gyakoribb jelenségnek, ahogy egy állam a terrorizmus fogalmával törvényen kívül helyez és kriminalizál nem kívánatos társadalmi csoportokat és tüntetőket. Press information Appeal process against Ahmed H. in Hungary: 10 years in prison for „Act of terrorism and illegal border crossing“ - The solidarity campaign is calling for his acquittal On June 15th, at 12pm the process against Ahmed H. will take place at the court of appeal in Szeged [1], Hungary. Ahmed has been sentenced to 10 years in prison in November 2016. The charges against him: illegal border crossing and „terrorism“. The sentence had created quite a stir across Europe. Ahmed was arrested on the 16th of September after mass protests on the southern border crossing Röszke. Hungary had closed its border to Serbia the night before. Thousands where suddenly stuck and could no longer flee along the Balkanroute. Ahmed H. had been arbitrarily arrested with ten other refugees (the so-called "Röszke 11"). By massively misusing 'evidences' the Court punished him very harshly for using a megaphone: Whereas the other ten have already completed their imprisonments of 1-3 years and could move on, Ahmed H. as their alleged 'leader' has faced prison reality since September 2015. In May 2017 the show trials against the Röszke 11 were also condemned by the European Parliament's resolution against Hungary.[2] Hungary's government recently responded by accusing the EU Parliament of supporting terrorism [3]. Other well-known international organizations criticized the judgement sharply [4]. Additionally an employee of the involved translation agency was recently convicted of perjury and sentenced because of manipulating and falsificating the statements of one defendant [5]. The high prison sentence is part of a Hungarian - but also European-wide - racist discourse against refugees, which serve as potential terrorists that can be targeted anytime by the state and the judiciary. This trial is an example of the extent to which authoritarian governments can use the terrorism discourse to delegitimize and criminalize unwelcome social groups and protest. We, the solidarity campaign "Free the Röszke 11" [6], which supports Ahmed H. and the other ten defendants, demand the acquittal and immediate release of Ahmed H. Additionally we demand compensation and the general rehabilitation of the other ten already convicted. Because: Freedom of Movement is not a crime! The consequence needs to be: Acquittal and compensation for all Röszke 11! Not guilty! We demand Freedom for Ahmed! The date for the trial against Ahmed at the second instance court is set for Thursday, 15th of June. In November 2016 Ahmed H. was sentenced to 10 years of prison for “terrorism” and “illegal border crossing” in the court of Szeged after a series of extremely biased trial hearings. Ahmed’s trial and the show-trials against the other Röszke 11, the police violence and the harsh policy changes are supposed to state an example and create an atmosphere of fear. They are part of the Hungarian state’s increasing racist propaganda against all migrants, especially Muslims and part of the European repressive migration policies. But freedom of movement is not a crime! We demand Freedom for Ahmed!
